
Terms of Use
Please read these Terms and Conditions (“Terms”) carefully before using the voizee.com website, the Voizee web application at app.voizee.com, or the Voizee mobile apps available on the Apple App Store and Google Play Store, all operated by BBG Solutions, Inc. d/b/a Voizee (“Voizee”, “we”, “us”, or “our”).
1. Acceptance of Terms
Your access to and use of the Service is conditioned on your acceptance and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.
2. Services and Access
If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, but not limited to, your address, credit card information, and website. Credit card information is stored through BluePay (see their Terms of Use here).
Some parts of the Service are billed on a subscription basis (“Subscription”). You will be billed in advance on a recurring monthly basis. You can cancel your Subscription at any point. This will terminate your access to the Service. No refunds will be provided. You can re-subscribe to the Service at any time.
Upon payment and acceptance, Voizee grants you a non-exclusive, non-transferable, revocable license to use Voizee’s communication platform, including SMS/MMS, calling, website widget, CRM, API, and Zapier integrations (“Services”), solely for your internal business purposes in accordance with Voizee documentation. You are responsible for ensuring your use complies with all applicable laws and carrier requirements.
3. Free Trial
Voizee may offer Services on a free trial basis, provided “AS IS” without warranties or obligations and with limited functionality. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid plan, and you agree to pay applicable fees.
4. Support and Updates
Voizee will provide reasonable support during your subscription. Voizee may release updates, enhancements, or modifications, which will be governed by these Terms. Voizee is not obligated to maintain legacy versions once updates are provided.
5. Fees and Payment
You agree to pay fees based on your selected subscription plan:
Pricing
All payments are non-refundable unless explicitly stated. A 1.5% monthly late fee or the maximum rate allowed by law may apply to overdue payments. Taxes, except those on Voizee’s income, are your responsibility.
6. Restrictions
You agree not to:
– Reverse engineer, modify, or create derivative works of the Services.
– Use the Services for spam, phishing, or unlawful activities.
– Violate A2P 10DLC regulations or carrier guidelines.
– Interfere with the security or functionality of the Services.
– Resell the Services without Voizee’s written consent.
7. Messaging Compliance
All SMS/MMS communications sent using Voizee must:
– Comply with all laws, carrier policies, and Voizee guidelines.
– Obtain clear opt-in consent before messaging.
– Include opt-out instructions (e.g., “Reply STOP to unsubscribe”).
– Be used only for approved business communications.
Prohibited categories include SHAFT content (Sex, Hate, Alcohol, Firearms, Tobacco), high-risk financial services, debt collection, and illegal or restricted products, as detailed in Voizee’s Forbidden Messaging Categories guide.
8. Customer Data
You retain ownership of your data while granting Voizee a license to use anonymized, aggregated data for service improvement. Voizee will take reasonable measures to secure your data but is not responsible for breaches outside its control.
9. Third-Party Services
You can integrate Voizee with other services using our API or Zapier; however, Voizee is not responsible for the performance or availability of these third-party services. Your use of these integrations is subject to the terms of service of the respective third parties.
10. Links To Other Web Sites
Our website may contain links to third party web sites or services that are not owned or controlled by Voizee. We have no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Voizee will not be responsible or liable, directly or indirectly, for any damage or loss caused, or alleged to be caused, by or in connection with use of or reliance on any such content, goods or services available on or through these third party web sites.
11. Term and Termination
Your subscription continues until canceled under Voizee’s cancellation policy or terminated by Voizee for violations of these Terms. Voizee may suspend or terminate accounts for misuse, non-compliance, or non-payment.
12. Disclaimer
VOIZEE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
13. Limitation of Liability
Voizee makes no warranties, expressed or implied, related to the service. We cannot guarantee that the Service will meet your requirements or operate without any interruption.
If the Customer is dissatisfied with the Service or with any terms, rules, conditions, policies, or guidelines of Voizee, then their only option is to discontinue using the Service.
14. Indemnification
You agree to indemnify Voizee against claims arising from your use of the Services or violations of these Terms, including legal fees and damages.
15. Refund Policy
Voizee offers a 14-day free trial, allowing you to evaluate the Services before payment. Once your paid subscription begins, fees are non-refundable, and no refunds will be issued unless explicitly stated.
17. Governing Law
These Terms are governed by the laws of the State of Colorado, USA. Disputes will be resolved by arbitration in Denver, Colorado.
16. Modifications
Voizee may update these Terms, and continued use of the Services constitutes your acceptance of the updated Terms. Material changes will be communicated via email or your Voizee account.
